TRESHNISH TERMS & CONDITIONS OCTOBER 2023
1. The Contract:
The contract for a short-term holiday rental is between the Owners
of Treshnish Farm (referred to as ‘us’ or ‘we’) and the person making the booking and all members of the party (referred to as ‘you’, ‘your’ ‘guests’) under the following booking conditions. Scottish law applies.
The Contract will be subject to the following booking conditions and must be complied with. The person named on the booking form is the “Responsible Person” and agrees to take full responsibility for ensuring the terms and conditions of the booking are adhered to by all the guests in the party.
The Responsible Person must personally stay in the accommodation throughout the duration of the booking, and must be at least 21 years of age at the time of booking. Names, addresses and ages of all members of the party must be shared with the Owners on request.
2a. Booking:
When you make a booking using our online booking system you will receive an automated booking summary by email. This does not form the beginning of a contract between us. The contract arises when your booking is subsequently confirmed by post or email.
2b. Bookings made by us:
If we have made the booking for you, please email and confirm in writing that you have read our Terms & Conditions October 2023 and that you accept them in full. We cannot confirm your booking until you have done this.
3. Payments:
Deposits for Shieling, East, Middle and West are £125 per short stay and per week.
Deposits for Shepherd’s Hut, Shian, Duill, Studio and Toechtamhor are £150 per short stay and per week.
Payment of the deposit must be received within 4 days.
We prefer payments made by bank transfer or by cheque (made out
to Treshnish Partnership). Payments can also be made by debit or credit card via the Supercontrol booking system and we do not charge a supplement for this.
The balance of the rental is due 60 days before arrival. You will be sent a balance reminder email a few days beforehand.
When a booking is made less than 60 days before arrival full payment will be due when making the booking.
4. Cottage and Shepherd’s Hut Extras:
Cottages: Any extras, such as electricity, heating and logs, must be paid for by cheque, bank transfer or in cash at the end of your stay. We cannot take card payments for these extras.
Shepherd’s Hut: Extras such as logs for the outdoor oven, wood burning stove and bath must be paid for by cheque, bank transfer or in cash.
5a. Cottages Electricity and Heating:
As part of the Treshnish Environmental Policy our guests take responsibility for their own energy consumption and pay for electricity and heating at the end of their stay according to metered usage. We take this into account when setting the prices.
This has been our energy policy since we opened in 1994, and as well as reducing energy wastage it allows us to avoid indirectly overcharging (by adding an average energy cost hidden in the booking price).
Both heating and electricity are metered and guests pay at the end of their stay by cheque, bank transfer or in cash. We allow for this cost when setting the cottage rental prices.
5b. Shepherd’s Hut Electricity and Wood:
Electricity is included in the rent for the Treshnish Shepherd’s Hut. A complimentary supply of logs on arrival is included. Further logs can be purchased on the farm.
6. Cancellations:
Cancellation by you: Cancellations must be immediately notified to us and confirmed in writing. The sooner you can inform us the better, as it gives us more time to re-let the accommodation.
The treatment of a cancellation will depend on
- when the cancellation is made and
- the reason for the cancellation
6a. If your booking has to be cancelled because Treshnish has to close through Force Majeure, meaning any of the following circumstances which may hinder or prevent the performance by us of the Contract, including but not limited to: (a) acts of God, flood, drought, earthquake or other natural disaster; (b) epidemic or pandemic; (c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; (d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government or public authority, including without limitation imposing a restriction, prohibition, or failing to grant a necessary licence or consent; (f) collapse of buildings, fire, explosion, damage or accident; (g) non-performance by our suppliers or contractors; and (i) failure of utility service, and the period of closure covers your booking you will be refunded in full. We would do everything we could to help you find alternative accommodation, but the value of your holiday is limited to the cost of the rental of the cottage or hut from us, and you shall have no further claim against us.
6b. Guests inability (or the inability of any, some or all guests) or disinclination to travel to and stay at Treshnish for any reason.
This includes – but is not limited to – illness (including Covid), a requirement or recommendation to self-isolate or quarantine, shielding, a call to jury duty, military service, incarceration, change in personal or work circumstances, family emergencies, travel delays, vehicle breakdown, and delays with public transport.
These remain at your risk and do not give rise to a right to cancel or to receive a refund unless we re-let the property, other than according to the sliding scale below.
6c. In the event of us not being able to re-let the accommodation following your cancellation, refunds are paid according to this sliding scale:
Cancellation 60 days or more in advance of arrival date:
Full refund of any payment already received, minus £25 admin fee
Cancellation 30 – 59 days in advance of arrival date:
50% refund of any payment received, minus £25 admin fee
Cancellation 8 – 29 days in advance of arrival date:
25% refund of payment received, minus £25 admin fee
Cancellation 0 – 7 days in advance of arrival date:
No refund will be possible as we will have incurred costs and it is very unlikely that we will manage to re-let the accommodation.
6d. Re-letting the accommodation and any subsequent refund.
On receipt of your cancellation, we will endeavour to obtain a replacement booking.
In the event that we are successful in obtaining a replacement booking, we will refund the total amount paid by the Guest for the booking less a £25 admin fee and less the difference in price between the cancelled booking and the replacement booking if one is made.
For example: A £500 booking, fully paid, cancelled and relet for £450, means that the original Guest will be refunded as follows: £500 – £25 admin fee equals £475. Less £50 rebooking shortfall results in a refund of £425.
We are more likely to re-let the accommodation with a longer lead in time, so please let us know as soon as possible if you need to cancel.
Any refunds due will be paid on or before the departure date of the original cancelled booking.
6e. Travel Insurance
It is the responsibility of the Guest to acquire suitable travel insurance to cover their holiday, including Cancellation and Curtailment Protection Insurance.
We strongly recommend that you take out suitable insurance which will cover circumstances beyond the Guest’s control such as, but not limited to, jury duty, incarceration, change in personal or work circumstances, military service, illness – including Covid and shielding, family emergencies and travel delays.
Covid is now a known risk and therefore it is possible for you to insure your holiday against it.
If you choose not to take out travel insurance you accept responsibility for any loss that you may incur due to your cancellation.
7a. Bookings are non-transferable. If you are not able to take the booking yourself, this will be interpreted as a cancellation. You cannot transfer your booking on to another party.
7b. Moving a booking: We can only move a booking if the arrival date of the original booking is more than 60 days ahead. There is a £25 admin charge for doing this. Any request to move a booking within 60 days of arrival date will be considered a cancellation.
8. Terms of Use:
Occupancy of the property is for the purposes of a holiday let referred to in paragraph 6 of schedule 1 of the Private Housing (Tenancies) (Scotland) Act 2016. You undertake to use the property solely for its purpose as a self- catering property and to accept the Owner’s right to refuse access to the accommodation to any person in the party deemed unsuitable.
9. Number of guests:
Occupancy of the property is restricted to the number of guests advertised for that property. This is governed by our Short Term Let License.
We reserve the right to refuse entry should this condition not be observed as to bring more guests than the property is advertised to sleep is breaking the law.
10. Arrival times:
Guests for the Treshnish cottages (SHIAN, DUILL, STUDIO, SHIELING) are welcome to arrive after 5pm on Friday and must depart by 9.30am on the morning of departure.
Guests for the Haunn cottages (TOECHTAMHOR, EAST, MIDDLE, WEST) are welcome to arrive after 5pm on Saturday and must depart by 9.30am on the morning of departure.
Guests for the Treshnish Shepherd’s Hut are welcome to arrive after 4pm and must depart by 10am on the morning of departure. Please check the arrival/departure day on your booking summary.
Guests who have booked a Short Break should check the Booking Summary carefully for their arrival and departure times as the above reference to arrivals on a Friday or Saturday may not apply.
11. Access and parking:
There is parking adjacent to all the cottages.
Shepherd’s Hut: On arrival guests park their car behind the farm steading in the allocated parking space for the Shepherd’s Hut. There is a wheelbarrow available to transport belongings to the Hut. It is a 350 meter walk over a track and through a field. Guests should bring wellies or sturdy footwear and a torch.
12. Right of Entry:
Sometimes it is necessary to gain entry to the property in the middle of a week (for example to allow for routine appliance testing or to allow tradesmen to carry out repairs). We will always try to give notice before gaining access but we reserve the right to enter at any reasonable time without notice should the need arise.
13. Dogs:
A maximum of 2 dogs per cottage (1 dog in Shepherd’s Hut) is permitted. There is a £20 charge per dog per booking. Occasionally we will accept 3 dogs – please contact us before making a booking.
Dogs must not be left unattended in the cottage (or Shepherd’s Hut) at any time. They must bring their own bedding and not get onto the furniture.
Dogs should be wormed and treated for fleas before arrival, and must be walked on a lead or under close control at all times (because we are a livestock farm). Pet owners must clean up after their pets in the garden.
14. Cleaning and Cleaning Products:
Guests should leave the cottage (or Shepherd’s Hut) as clean as they find it, and we provide a range of eco-friendly cleaning products for this purpose.
We reserve the right to charge guests for extra cleaning should the cottage require it on departure.
Chemical sensitivity: Please email us if you need to know exactly what products we use.
15. Visit Scotland Standards:
Toechtamhor (4*) and West (3*) are regularly inspected and graded by VisitScotland.
Please note: Studio is a similar standard to Toechtamhor, and the other cottages are equipped and furnished to a similar standard as West but they are not in the VisitScotland grading scheme.
16. No Smoking or Vaping:
All the Cottages and the Shepherd’s Hut at Treshnish are Non-Smoking and Non-Vaping.
17a. Cottages with Wi-Fi:
Toechtamhor, Studio, Shian, Shieling and Duill: These cottages have unlimited Wi-Fi via the EE mobile network. We cannot be held responsible should the broadband signal become unavailable, for whatever reason.
17b. Cottages and Shepherd’s Hut without Wi-Fi:
East, Middle and West: There is Wi-Fi at the Hub for guests staying in East, Middle and West to use for checking emails, weather forecasts et cetera.
Treshnish Shepherd’s Hut: There is strong 4G mobile reception in the Shepherd’s Hut. Vodafone, EE and 02. Guests can also access the internet in the Hub.
18. The Hub: The Hub is located on the south side of the Treshnish farm steading at the Haunn end of the wooden lean to. Look for the Puffin sign.
There is a Wi-Fi connection here, and a library of books which guests are welcome to borrow – but please return before departure.
There is a washing machine available for guests to use.
There is a Defibrillator outside and a First Aid Kit inside.
We cannot be held responsible should the broadband signal become unavailable, for whatever reason.
19. Mobile signal:
There is 3G/4G Vodafone, 02 and EE mobile signal at Treshnish. Signal works in all gardens but won’t necessarily work indoors because of the cottages’ thick stone walls.
20. Water:
Because of our remote location we are unable to access mains water supply. The Treshnish cottages and Shepherd’s Hut water supply is from a borehole.
Toechtamhor and the Haunn Blackhouses (East, Middle and West) water comes from 2 separate springs.
All supplies are filtered and treated with UV light. They are regularly tested and maintained in accordance with current regulations.
21a. What we will provide:
Bedding, bedlinen and towels.
Hand soap in each kitchen and bathroom.
Dew Product Disinfect spray, hand sanitiser.
Cleaning products and washing up liquid.
Bath mats, tea towels and oven gloves.
21b. What you need to bring with you:
There are no street lights, so please bring a Torch.
Bring Slippers to wear indoors instead of shoes.
We don’t leave cooking oils, teas, coffees in the kitchen so please remember to bring your own. (There is Salt and Black Pepper though).
Please bring your own swimming/beach towels.
22. Lost property:
It is the responsibility of guests to contact us if they leave any belongings behind. In this instance we can post them back to you.
After 2 months we will take unclaimed belongings to Castaways in Craignure.
23. Updating the booking conditions:
From time to time we may need to update the Terms and Conditions. We
reserve the right to update and modify them at any time.
Should you decide not to accept the amended Terms and Conditions please
let us know and we will cancel your booking and refund you in full.
24. Covid-19:
Please cancel your stay if you or any of your party are unwell and have possible symptoms of Covid-19, including raised temperature, dry irritable cough, loss of sense of taste or smell.
